In Italy the law says the data “sono raccolti entro” (are collected by) these dates. How they are submitted depends on a ministerial decree; its adoption was not verified as of October 10, 2026.

Legal basis: Art. 9, comma 8, D.Lgs. 96/2026; Art. 9, comma 9, D.Lgs. 96/2026; Art. 9(2) Directive (EU) 2023/970; Art. 9(3) Directive (EU) 2023/970; Art. 9(4) Directive (EU) 2023/970; Art. 9(5) Directive (EU) 2023/970

Joint pay assessment (art. 10): likely required if a category shows a gap of at least 5 % that is neither justified nor corrected within six months.

Legal basis: Art. 10(1) Directive (EU) 2023/970; Art. 10, comma 1, D.Lgs. 96/2026

For every employer, whatever the size

Pay information to job applicants and no questions about pay history (art. 5).

Legal basis: Art. 5(1) Directive (EU) 2023/970; Art. 5(2) Directive (EU) 2023/970; Art. 5(3) Directive (EU) 2023/970; Art. 5, comma 1, D.Lgs. 96/2026

Pay-setting and pay progression criteria easily accessible to workers (art. 6).

Legal basis: Art. 6(1) Directive (EU) 2023/970; Art. 6(2) Directive (EU) 2023/970; Art. 6, comma 3, D.Lgs. 96/2026

Workers can ask in writing for pay information; reply within two months, and tell all workers about this right every year (art. 7).

In Italy a worker can make this request once a year.

Legal basis: Art. 7(1) Directive (EU) 2023/970; Art. 7(3) Directive (EU) 2023/970; Art. 7(4) Directive (EU) 2023/970; Art. 7, comma 1, D.Lgs. 96/2026; Art. 7, comma 4, D.Lgs. 96/2026

  • [F] Art. 9, comma 9 says the data 'sono raccolti entro' (are collected by) the due dates; collection rules are set by ministerial decree(s) under art. 9, comma 4, due within 90 days of entry into force (adoption not verified at 2026-10-10).
  • [F] Art. 3, comma 1, lett. b): 'livello retributivo' covers continuous and fixed pay elements and excludes non-structural individual treatments (personal, discretionary or temporary, not generalised within the category): map payroll items accordingly.
  • [F] Art. 9, comma 7: reasoned reply to requests for clarification within 60 days.
  • [F] Art. 4, comma 1: applying a CCNL signed by the comparatively most representative unions is a presumption of conformity; categories follow CCNL classification levels (art. 4, comma 2).
  • [A] Art. 9, comma 8 counts 'dipendenti' without a counting method (art. 6, comma 3 uses art. 18 L. 300/1970 for the under-50 exemption).
  • [A] The directive does not define how workers are counted (head count or FTE, part-time, reference date); national law decides.
